Therefore, before detailing the technical specifications, I would like to outline the most important information.
- A lifetime usufruct right in the case of an apartment means that the usufructuary is entitled to possess and use the property until the end of their life.
- In the current situation, the owner of the apartment is the daughter of the former owner, while the usufructuary is the wife from the former owner’s second marriage (currently 57 years old).
- The usufructuary is entitled to live in the apartment or rent it out to a third party and collect the rental income.
- During the existence of the usufruct right, the owner is only the legal owner; therefore, the apartment cannot be used without the consent of the usufructuary.
- The property can be sold, but only with the usufruct right attached, which will also bind the new owner.
- The usufructuary bears the daily maintenance costs and utility expenses.
- Responsibility for major renovations and structural repairs is not clearly defined and is subject to mutual agreement.
- The usufruct right automatically terminates upon the death of the usufructuary.
At that point, the owner may dispose of the apartment with full rights and without restriction.
